RULES OF ENGAGEMENT
Setting Expectations for Managed WordPress Care Plans
The following outlines the terms, conditions, and important considerations for FMK Agency’s Managed WordPress Care Plans. These guidelines ensure clarity and alignment between FMK Agency and our clients, fostering a successful and transparent partnership.
The following information ensures a clear understanding of the scope, responsibilities, and limitations of our partnership, empowering us to deliver exceptional service and support tailored to your needs. If you choose to engage in Managed WordPress Care Plans, you will acknowledge and agree to these terms in a separate agreement during onboarding.
Service Hours and Additional Requests
- The number of support and development hours included in each plan is fixed based on the selected tier (Core, Growth, or Enterprise Care Plan).
- Requests that exceed the allotted hours will be evaluated and quoted separately at our standard hourly rate or per project, depending on the scope and complexity of the request.
Hosting Responsibilities
- Hosting fees are the client’s responsibility and are paid directly to the hosting provider of your choice. FMK Agency will recommend suitable hosting providers based on your needs but will not manage hosting payments on your behalf.
- The hosting environment must allow FMK Agency administrative-level access as a guest or collaborator to ensure we can perform maintenance, updates, and troubleshooting.
- FMK Agency will advise on hosting configurations but is not responsible for server-level outages caused by hosting providers.
Performance and Results Expectations
- FMK Agency provides services to maintain, secure, and optimize your WordPress website. While we strive to minimize downtime, improve performance, and secure your platform, we do not guarantee specific percentages or numerical improvements (e.g., 99.99% uptime, a specific page speed score).
- Results depend on several factors, including hosting environment, third-party integrations, and overall system complexity. Our role is to collaborate as an extension of your team, offering expertise and proactive solutions.
Third-Party Tools and Integrations
- FMK Agency will maintain and troubleshoot integrations with third-party tools (e.g., CRM, marketing automation platforms, customer support systems) as part of your care plan.
- Any significant reconfiguration or new integration requests will require additional scoping and may incur additional fees.
- Clients must provide all necessary credentials and access permissions to third-party tools to ensure seamless support.
Scheduled Maintenance and Updates
- System updates, optimizations, and scheduled downtime will be performed during off-peak hours to minimize disruption to your operations.
- FMK Agency will notify clients of any major updates or planned maintenance that may affect system availability.
Client Responsibilities
- Collaboration and Timely Communication: Clients are expected to provide timely responses to requests for information, approvals, or access to systems.
- Ownership of Content and Data: The client is solely responsible for the content, data, and intellectual property hosted on their WordPress site.
- Backup Storage: While FMK Agency performs regular backups, clients are encouraged to maintain their own copies of critical data as an additional layer of security.
Limitations of Liability
FMK Agency is not responsible for:
- Server-level issues caused by third-party hosting providers.
- Losses incurred due to misuse or unauthorized changes made by the client or third parties.
- Downtime caused by force majeure events, including but not limited to natural disasters, cyberattacks, or power outages.
Amendments and Adjustments
- FMK Agency reserves the right to update this disclaimer or adjust service offerings as necessary to reflect changes in technology, best practices, or client needs.
- Clients will be notified of any significant changes to terms or conditions.
